What is the EB-2 NIW?

The EB-2 National Interest Waiver is a Green Card category for professionals with an advanced degree (master's or PhD) or exceptional ability, who do not need sponsorship from a US employer — provided they demonstrate that their work benefits the national interest of the US.

The legal standard used is the "Matter of Dhireen" test, which evaluates three pillars: substantial merit and national importance of the proposed work, the professional's favorable position to carry it out, and national benefit that outweighs the interest in following the standard process requirements.

Ideal profile in 2026

STEM professionals (science, technology, engineering, and mathematics), healthcare, education, and public policy continue to see more favorable approvals. Researchers with significant publications and citations, doctors willing to work in underserved areas, and engineers in strategic fields have the most robust petitions.

Important note: EB-2 NIW is a petition process, not an interview. The quality of the petition — strong recommendation letters, evidence of real impact, well-structured legal argumentation — is what determines approval or denial.

Current timelines for Brazilians

Approval of the I-140 petition (EB-2 NIW) is taking between 12 and 24 months in regular processing in 2026. Premium Processing reduces this to 45 business days, at an additional cost of approximately US$ 2,805. After I-140 approval, the wait for the cutoff date depends on the monthly Visa Bulletin.

Is it worth it in 2026? Our analysis

For the right profile, absolutely yes. It is the only Green Card route that does not require a sponsoring employer or labor certification process (PERM), giving the professional full autonomy. For those with the right profile and no US employer, it is often the best — and sometimes the only — available path.
